ATLEU Training: Modern Slavery Framework Overview
An overview of the Modern Slavery framework and processes with Beth Mullan Feroze.
This training is designed to provide legal advisors who are interested in working in this area or support professionals working with survivors of trafficking or Modern Slavery including those working within and those working outside of the MSVCC with an overview of the legal frameworks around Modern Slavery and the National Referral Mechanism (NRM).
During the session we will look at:
- Definitions and indicators of trafficking and modern slavery
- Legal framework: Relevant sources of law
- Legal framework: An overview of the NRM process
- Legal changes following the Nationality and Borders Act 2022 and how these operate in practice. This will include a brief discussion on public order disqualification decisions and Temporary Permission to Stay (also known as VTS leave)
- Different types of evidence that can be gathered and how to respond to requests for an account of exploitation and/or statements
- A brief introduction to the types of legal challenges: Reconsideration, Judicial Review and asylum appeals and other appeals.
- When legal aid is available
In this interactive session, participants will be able to talk through practical scenarios they have experienced when working survivors who are going through NRM.
The aim of the session is to increase training participants’ confidence and provide a better understanding of the processes that the survivors will be going through and how they can challenge negative decisions.
